SMS / Text Messaging Terms

Enrollment & Consent

When you provide a mobile number and check an SMS consent box on our forms (or otherwise ask to receive texts), you authorize Mole Marketing to send SMS messages to the number you provided. Consent is not required to make a purchase.

Program Description

Text messages may include: appointment confirmations and reminders, scheduling or rescheduling links, follow-ups related to support or quotes, and—only if you separately opt in—occasional promotional messages.

Frequency, Fees & Availability

Message frequency varies. Message and data rates may apply. The SMS program may not work with all carriers or in all areas. Carriers are not responsible for delayed or undelivered messages.

Opt-Out

Reply STOP to cancel. After you send STOP, we may send a one-time confirmation of your opt-out. You can also request removal by emailing service@mole-marketing.com

Your Responsibilities

You confirm you are the owner of the mobile number provided (or have permission to use it) and you agree to notify us if your number changes or is reassigned.

Eligibility

You must be 18+ to enroll. (If you truly require U.S. residency for your SMS program, keep this sentence; otherwise remove it.)
Optional clause: “Enrollment is intended for U.S. residents only.”

Privacy

Your participation in SMS messaging is governed by our Privacy Policy, including how we handle opt-in records and message logs.

Changes & Termination

We may update, pause, or discontinue the SMS program at any time. Updates are effective once posted to these Terms.


Links to Other Websites

The Service may contain links to third-party websites or services that are not owned or controlled by the Company.

We do not control, and are not responsible for, the content, policies, or practices of third-party sites or services. You acknowledge that we are not liable for any loss or damage that may result from your use of, or reliance on, third-party content, goods, or services.

We recommend reviewing the terms and privacy policies of any third-party sites you visit.


Termination

We may suspend or end your access to the Service immediately, without notice, if we believe you have violated these Terms or for any other reason, as permitted by law.

If access is terminated, your right to use the Service ends right away.


Limitation of Liability

To the fullest extent permitted by law, the Company’s total liability (and the liability of its suppliers) for any claim arising out of or relating to the Service is limited to the amount you paid through the Service, or $100 USD if you have not made any payment through the Service.

To the maximum extent allowed by applicable law, the Company and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, loss of data, business interruption, personal injury, or privacy-related claims) arising from or connected to your use of—or inability to use—the Service, even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations. Where those rules apply, liability will be limited to the greatest extent permitted by law.


“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” and may contain errors or defects. To the fullest extent allowed by law, we disclaim all warranties of any kind—express, implied, statutory, or otherwise—including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Service:

  • will meet your requirements,
  • will be uninterrupted, timely, secure, or error-free,
  • will be compatible with all software/systems, or
  • will be accurate, reliable, or up to date.

We also do not warrant that emails or content delivered by us (or through our systems) will be free of viruses or other harmful components.

If applicable law grants you certain non-waivable rights, these disclaimers apply only to the extent legally permitted.


Governing Law

These Terms and your use of the Service are governed by the laws of USA, excluding its conflict-of-law rules. Your use of the Service may also be subject to other local, state, national, or international laws.


Dispute Resolution

If you have a concern or dispute, you agree to first contact us and attempt to resolve the issue informally before pursuing other actions.


Severability and Waiver

Severability

If any part of these Terms is found invalid or unenforceable, that provision will be interpreted or modified to achieve its intended purpose to the extent possible, and the remaining provisions will continue in effect.

Waiver

If we do not enforce a right or requirement under these Terms, that does not waive our right to enforce it later. A waiver of one breach is not a waiver of any later breach.


Translation Interpretation

If these Terms are translated, you agree that the original English version controls in the event of a dispute.

We may update these Terms at any time. If changes are significant, we will make reasonable efforts to provide notice (for example, by posting a prominent notice on the Service) before they take effect. What counts as a “significant” change is determined by us.
